1. General

The Calculatis by Stora Enso (hereinafter referred also to as the “software”) is technical design software for cross laminated timber (CLT), laminated veneer lumber and other wood products and building materials. The technical design includes structural analysis and building physics. The software is online software that can be operated through a web browser. No installation on a computer is required. To access the software, a registration process needs to be completed and the terms of use have to be accepted.

2. Intellectual property and copyright

The software was created by Mursoft, Wörgötter, Kump OG (Graz, Austria) for Stora Enso Wood Products GmbH. All intellectual property rights in the software rest with Stora Enso Wood Products GmbH.

3. Registration

The use of the software requires an initial registration at the website of the software. The user is obligated to indicate true and correct data in the registration form. Stora Enso Wood Products GmbH is reserving and managing all licensing rights (rights to use the software). If a newly registered user will receive license rights, is subject to be decided by Stora Enso Wood Products GmbH. A registered user cannot claim to receive access to the software unless given by Stora Enso Wood Products GmbH.

4. Accessibility

The Calculatis by Stora Enso is online software. Therefore it is dependent on the server that it is based on and the internet connection to the user´s computer. Server downtime, any kind of network problems on the internet or connection problems at the user´s computer can cause temporary inaccessibility of the software. Stora Enso Wood Products GmbH cannot be held liable for the availability of the software at any time and the data entered by the user. The Software was designed to run equally on Microsoft platforms, using Internet Explorer as a web browser. Due to the nature of the software, it is likely that it will perform just as well on Macintosh platforms, using any other browser than Internet Explorer. The software might be operated from tablet computers (e.g. iPad) in a similar way as through a desktop/laptop computer. However, Stora Enso Wood Products GmbH does not guarantee compatibility with any computer system.

5. Accuracy and correctness

The software was programmed according to the current state of the art knowledge in structural analysis and building physics. Many local national regulations (Austria, Finland, France, Italy, Spain, Switzerland, United Kingdom and Australia) have been implemented in the software, such as national annexes of the Eurocode regulations. However, complete coverage of all national and local regulations cannot be guaranteed. The software was created to assist engineers in their daily business. The software is engineering software that is dealing with a very complex matter of structural analysis and building physics analysis. Therefore, this software shall only be operated by skilled, experienced engineers, with a deep understanding of structural engineering and building physics related to timber structures. The user of the software is obliged to check all input values, no matter if they were given by the user or given by default by the software and all results for plausibility. The use of the results of the software should not be relied upon as the basis for any decision or action. Any use of results of the software is only allowed if the results have been verified and approved regarding completeness and correctness by a project structural/building physics engineer. The user has the possibility to make print-outs from the software. Any modifications of those are not allowed.

6. Warranty and liability

The software is being provided on the website currently free of charge and on an “AS IS” basis. Consequently, Stora Enso Wood Products GmbH does not assume any warranty regarding the software. The software has been developed with utmost diligence, nevertheless Stora Enso Wood Products GmbH, neither expressly nor implicitly, provides any warranty in terms of accuracy, validity, timeliness and completeness of information and data created by the software. Stora Enso Wood Products GmbH does not either assume any warranty for the general usability of the software, its suitability for a special purpose or for the compatibility of the software with the ones of third party producers or providers. Stora Enso Wood Products GmbH is only liable for damages caused by its gross negligence or willful misconduct; the liability for slight negligence is excluded. This does not apply to personal injuries. Under the aforementioned conditions, Stora Enso Wood Products GmbH is not liable for any consequential or indirect damages, operational failures or the loss of programs and/or data of the user’s data processing system.

7. Registration data

It is required to sign up at the website of the software in order to use the software. The collected data is being collected by Stora Enso Wood Products GmbH. The collected registration data will be held confidential. The collected data may, however, be shared within the Stora Enso group.
When you are using Calculatis, Stora Enso Wood Products GmbH may collect the following personal data: name, title, job title, postal address, email address, phone number, company name and occupational sector (e.g. engineer or carpenter). This data is used for the purposes of technical implementation of the tool, identification, making contact for support purpose and necessary system update information on the software.
When you are using Calculatis, Stora Enso Wood Products GmbH may collect the following project related data: all project related design data that is being entered and selected by the user. All design data and project related data entered by the user will be stored on the same server of Stora Enso Wood Products GmbH that will host the software.
The user can decide, whether or not this data may be accessed by Stora Enso Wood Products GmbH and its staff members with administrator rights. In order to get user support, it can be helpful for the users to grant access to Stora Enso Wood Products GmbH already in advance. If the user agrees to the access by Stora Enso Wood Products GmbH, the data will not be treated as confidential. In this case, the user grants Stora Enso Wood Products GmbH a perpetual, non-exclusive, worldwide and transferable right to use its data free of charge. This right applies to any type of use known today and in future and it contains, in particular, the right of reproduction, processing, adaption, dissemination, making available and placing on the market in any conceivable manner, translation of all data and information for any purpose, including, without limitation commercial purposes. Stora Enso Wood Products GmbH reserves the right, at its own discretion and without prior notification, to remove or to delete data and information that has been submitted for the use of the software at any time.

8. Applicable Law

These terms of use shall be governed by the laws of Austria excluding its conflict of laws rules. The Convention of the International Sale of Goods (CISG) shall not be applied.
